I hereby release, discharge, and hold harmless the City of Cincinnati, the Cincinnati Park Board, their agents, employees, attorneys, directors, donors, sponsors and volunteers from all claims of whatever nature, including but not limited to personal injury or death and property damage.
I understand that there are risks, known and unknown, associated with volunteering at Cincinnati Park sites, including but not limited to injury by tools and hazardous or hidden substances or materials; and I assume all such risks arising from this volunteer activity.
I understand that the Parks staff and all other volunteers are not qualified to administer emergency medical or first aid care. I consent to the securing of an emergency vehicle on my behalf in the event that I am incapacitated or injured.
I also consent to the use of my photograph, without compensation or payment, or likeness in connection with publicity or information about the Cincinnati Parks.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and health agencies recommend social distancing, wearing facial coverings, and have, in many locations, prohibited the congregation of groups of people.

The City of Cincinnati and the Cincinnati Park Board (collectively “Parks”) have created protocols and preventative measures to help reduce the spread of COVID-19. By participating in Parks’ activities and programs (“Parks’ programs”), you agree to follow all such protocols and all federal, state, and local laws and orders governing prevention and treatment of COVID-19, including but not limited to the following: Do not participate in Parks’ programs if you or someone in your home is symptomatic (e.g., fever, cough, shortness of breath), or if someone you’ve come into close contact with is under investigation or diagnosed with COVID-19; use face coverings and practice social distancing at all times while on the site; keep at least six feet from other people even when working outside; use gloves at all times to handle tools and equipment. Parks will provide hand soap, sanitizer, and cleaning supplies such as Clorox and paper towels on site. You must frequently use these cleaning products for yourself and for equipment between uses. If you do not see cleaning products, ask a Parks’ representative and they will be provided to you. Parks cannot guarantee that you or others will not become exposed to or infected with COVID-19 by participating in Parks’ programs regardless of whether the protocols, laws, and orders are followed, and regardless of Parks’ reasonable efforts to protect against the spread of COVID-19.

By signing this agreement, I agree to adhere to the above protocols and rules governing COVID-19. I agree that my attendance or participation in any Parks’ program may increase the risk of contracting COVID-19. I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I or others may be exposed to or be infected by COVID-19 by attending or participating in Parks’ programs, and that such exposure or infection may result in personal injury, illness, permanent disability, or death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Parks’ program may result from the acts, omissions, or negligence of myself and others, including, but not limited to, Parks’ employees, agents, volunteers, and other program participants. I understand that based on the inherent nature of Parks’ programs and proximity to other people, it is impossible to prevent all potential sources of transmission of COVID-19 despite all reasonable efforts of Parks.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or others I come into contact with, including but not limited to personal injury, disability, or death, as well as any illness, damage, loss, claim, liability, or expense, of any kind, that I or others may experience or incur in connection with my participation in the Parks’ program due to exposure or infection by COVID-19. I hereby release, covenant not to sue, discharge, and hold harmless Parks, its employees, agents, and volunteers, from any and all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to my participation in the Parks’ program. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Parks, its employees, agents, and volunteers, whether a COVID-19 exposure or infection occurs before, during, or after participation in the Parks’ program.
The individual named below (referred to as "I" or "me") desires to participate in the “Everybody in Mt Airy with Luke5Adventures” program in partnership with Luke5Adventures and the Cincinnati Parks Foundation, an Ohio non-profit corporation, located at 421 Oak Street, Cincinnati, Ohio (the "Foundation"). As lawful consideration for being permitted by the Foundation to participate in the Activity, I agree to all the terms and conditions set forth in this agreement (the "Agreement").

I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE DANGEROUS ACTIVITIES AND INVOLVE THE RISK OF SERIOUS INJURY AND/OR DEATH AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY BE COMPOUNDED BY NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF FOUNDATION. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE FOUNDATION OR OTHERWISE.

I hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against the Foundation, and its officers, directors, employees, agents, volunteers, vendors, contractors, affiliates, shareholders, successors and assigns (collectively, "Releasees"), arising out of or attributable to my participation in the Activity, whether arising out of the negligence of the Foundation or any Releasees or otherwise. I covenant not to make or bring any such claim against the Foundation or any other Releasee, and forever release and discharge the Foundation and all other Releasees from liability under such claims.

I further consent and authorize the Foundation and any of its subsidiaries, and anyone else they may authorize, to use photographs, audio recordings and/or video recordings taken of me in connection with the Activity, including my name, likeness and voice, as well as any testimonial statements made by me (“Publicity Items”), and any reproduction of them in any form, for the purpose of publicizing, promoting and advertising the Foundation’s activities in any media now known or later developed, in perpetuity and throughout the world. I acknowledge that I will receive no fee for the use of my name, statements and Publicity Items herein. I further acknowledge that the Foundation is the owner of all rights in and to the photograph(s), motion pictures and video of my image described above.

This Agreement constitutes the sole and entire agreement of the Foundation and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of the Foundation and me and our respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of Ohio without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Agreement may be brought only in the federal and state courts located in Hamilton County, Ohio, and I hereby consent to the exclusive jurisdiction of such courts.

BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE FOUNDATION.
In consideration of the acceptance given the undersigned by GRACE CHAPEL and Luke5Adventures, for participation in the hike or trek, the undersigned, for good and
valuable consideration heretofore mentioned, the receipt of which is hereby
acknowledged, does by these presents hereby forever release and discharge GRACE
CHAPEL and/or Luke5Adventures, their employers, employees, principals, agents,
insurers, successors, and assigns, for and from any and all liability, claims, demands,
controversies, damages, actions, and causes of action arising out of, or resulting from
the undersigned’s participation in the above described activity or event, including but not
limited to all liability, claims, or demands for personal injury, sickness, or death, as well
as property damage and expenses arising out of, directly or indirectly, the
aforementioned activity or event.
The undersigned acknowledges the risks inherent in the aforesaid activity or event
and hereby voluntarily and knowingly assumes those risks and acknowledges that, in
releasing and waiving all claims, demands, actions, or causes of action heretofore
mentioned, that undersigned does so on behalf of himself or herself, his or her heirs,
executors, administrators, successors, and assigns.
The undersigned represents that he or she fully understands the intent, meaning, and
import of this agreement and has read the same prior to signing.
The undersigned, by signing this agreement, authorizes the aforementioned parties
to provide or furnish any necessary transportation, food, or lodging associated with this
activity or event. Further, participant does hereby acknowledge his or her status and
capacity of that of a licensee only, with respect to any real property used or occupied in
conjunction with the aforementioned activity or event and does also hereby release and
discharge owner, and occupier of said real property from any and all liability, claims,
demands, controversies, damages, actions, and causes of action arising out of the use
for occupation of said real property.
The undersigned further hereby agrees to indemnify and save harmless the
aforementioned parties, their employers, employees, principals, agents, insurers,
successors, and assigns from any liability incurred by said parties resulting from the
negligent, willful, wanton, or intentional acts of the undersigned.
The undersigned hereby acknowledges the receipt of rules and regulations
promulgated and distributed by the parties and hereby agrees to abide by the same and
further agrees to adhere to the directions of those in authority and leadership for the activity or event.

I ________________________________, or as the parent/gardian of ______________________________ hereby give my consent to be photographed and for my image to be used in print and/or social media by Grace Chapel dba Luke5Adventures. I understand that, if in the future, I want to revoke this permission, that I must make that request in writing to the Director of Luke5Adventures
